Conditions Générales de Location

1- BOOKING
The Villa-Riad access is just possible for the persons who have a written confirmation of their reservation.
For the reservations made 1 month before the arrival day, the all price of the rent will be due at the confirmation.
ABALYA SARL is able to cancel all reservation for the one the account or the integral payment would not be received. The payments must be established to SARL ABALYA or another physical or moral person determined by ABALYA SARL

2- LAST ACCOUNT
The last account must be paid 3 weeks before the departure. If it is not paid, it causes the immediate cancellation of the reservation.

3- CANCELLATION BY THE CLIENT
The cancellation by the tenant for any reason must be submitted to variable allowances depending on the date you will decide the cancellation of the Villa ABALYA:
- More than 60 days: 10 % of the rent price.
- Between 60 and 45 days : 25 % of the rent price
- From 45 to 30 days: 50 % of the rent price.
- Less than 30 days: 100 % of the rent price..

4- CANCELLATION BY ABALYA SARL BEFORE THE ARRIVAL DAY:
Any cancellation or modification for any confirmed and paid reservation will be notified to the client and will be totally paid back. As far as possible, ABALYA will propose to the client another solution of the same category or higher one without any price change.

5 – ARRIVAL AND LEAVE AT THE VILLA
The driver will welcome the client at the airport. The Villa will be available at 3.00 PM, and will be let at 11.00 AM. In case you have to leave later, the luggage can stay in the entry of the Domain Jnan Zeitoun under your responsibility.

6 – RENTAL CONDITIONS
The Villa-Riad ABALYA must be cared as usual education rules. Each client must preserve the quietness of the Domain and take care not to disturb the others persons in the Domain. A correct behaviour and dress code are asked so as to respect the Moroccan habits. The animals are forbidden. The Villa-Riad is only rented for touristic journeys. A guarantee of 2.000 euros will be let at the arrival for any degradation of the Villa-Riad.
The client must declare, as soon as possible if there is any problem or accident in the Villa or Domain.
The client won’t be able to refuse the visit of any representant of ABALYA SARL. An inventory will be done at the arrival and at the leave of the clients.
At your leave of the Villa, the guarantee will be returned to the client, if no degradation.

7 – RESPONSABILITIES ABALYA
ABALYA SARL and the Domain, and all the staff, do not have any responsibility concerning the accidents and their direct and indirect consequences for the persons who are staying in the Villas.
ABALYA advert the client the swimming pools, private and commune, the games areas and the tennis grounds are not being supervised.
Their use are only under your responsibility, ABALYA SARL recommends the best care possible concerning the use of the swimming pool for the children.
The clients will not allow children playing alone in the swimming pool and declare assure all the responsibility.
ABALYA SARL and the Domain will not be responsible for any gas or electricity national rupture.
The personal goods are under the client responsibility. Some “security cases” are available for any important good.

8 – CARS
A car can be available under payment of the guarantee : 2 000 euros. An inventory and a contract will be established. The driver(s) will have to dispose of a valid driver licence, dating of more than 10 years, and will respect the Moroccan rules. The use of the car is limited at 100 km/day only on built roads. Any km more will be billed as 0,5 euros by km. The use in the desert or rally is strictly forbidden. The client will have to return the car in the same state that it was let and will be responsible for any degradation. The amount of the fixations will be deduced from the guarantee. If the degradations are more important than the guarantee let, a cheque will be asked before the departure of the client. The driver(s) must have a civil guarantee for any damage on the persons, goods and car. ABALYA SARL declines any responsibility concerning technical problems and will do everything to give to the client another car. If any accident is caused by the driver, SARL ABALYA doesn’t have to give another car.

9 – ACCESS TO THE RESIDENCE INFRASTRUCTURES
The client has to see with the managers the rules and the use of the different infrastructures of the Domain.

10– EXTERNAL VISITORS
The Domain Jnan Zeitoun is totally guarded night and day. Only the clients and owners have a permanent access. As a consequence, the clients have to prevent the guardian for any external visitor at least the day before. The complete identity will be asked and can be checked. The manager and the guardian can refuse the entry, without justification, even if they had accepted before. The present contract and the interior rules are the same for the externals visitors. The arrivals of the external visitors are allowed until 10H.00 PM. Then, the access is forbidden for security reasons.

11 – CANCELLATION
The signature of this present contract implies all the occupants of the Villa-Riad accept the Generals Rules of the Domain.
The non-respect of those General Rules will precise an instantly cancellation without any indemnity. The Clients, occupants and external visitors will have to let the Villa-Riad into 2 hours.

12 – JURIDICTION ATTRIBUTION
In case of contestation concerning the execution of the presents, the exclusive jurisdiction attribution is for the Moroccan Courts (Morocco).
